2.1 Platform Description

Flexiibook provides a multi-tenant scheduling and booking system that allows Businesses to offer services to Customers. Flexiibook does not provide any services directly to Customers, nor does it employ any service providers.

2.2 Relationship Between Parties

Flexiibook acts solely as an intermediary platform connecting Businesses and Customers. We are not agents for either party. Any contract for services is formed directly between the Customer and the Business.

2.3 Platform Availability

While we strive to ensure Flexiibook is available 24/7, we cannot guarantee uninterrupted access. We reserve the right to suspend, restrict, or terminate access to Flexiibook at any time without notice for maintenance, updates, or other reasons.

3.1 Booking and Payments

1. Direct Relationship: When you make a booking through Flexiibook, you enter into a direct contractual relationship with the Business, not with Flexiibook.
2. Payment Processing: All payments are processed directly by the Business or their designated payment processor. Flexiibook does not handle, process, or receive any payments from Customers.
3. Booking Confirmation: A booking is only confirmed once you receive confirmation from the Business, not merely upon submission through Flexiibook.
4. Service Disputes: Any disputes regarding the quality, performance, or delivery of services must be resolved directly with the Business. Flexiibook cannot mediate or resolve such disputes.

3.2 Customer Responsibilities

1. Provide accurate, current, and complete information when creating an account or making bookings.
2. Comply with any cancellation policies set by the Businesses.
3. Arrive on time for appointments and follow any Business-specific rules or guidelines.
4. Treat Business premises, staff, and other customers with respect.
5. Pay for services as agreed with the Business.

3.3 Membership Benefits

Some Businesses may offer membership benefits or exclusive access through Flexiibook. These memberships are offered by the Businesses directly, not by Flexiibook. Terms, conditions, and benefits of memberships are determined solely by the Businesses.

4.1 Service Provision

1. Direct Responsibility: As a Business, you are solely responsible for the services you offer, their quality, safety, legality, and delivery.
2. Accurate Information: You must provide accurate, up-to-date information about your services, prices, location, availability, and any special requirements or restrictions.
3. Service Fulfillment: You are obligated to honor all confirmed bookings made through Flexiibook unless canceled according to your stated cancellation policy.
4. Legal Compliance: You must comply with all applicable laws and regulations related to your business, including but not limited to licensing, insurance, health and safety, data protection, and consumer rights.

4.2 Payment Collection

1. Direct Collection: You are responsible for collecting all payments directly from Customers. Flexiibook does not handle payment processing between you and your Customers.
2. Pricing Transparency: You must clearly communicate all prices, fees, and payment terms to Customers before confirming bookings.
3. Refund Policy: You must establish and communicate a clear refund and cancellation policy to Customers.

4.3 Platform Usage

1. Pay all applicable subscription or usage fees to Flexiibook as agreed.
2. Not misuse the platform or attempt to circumvent any platform features or limitations.
3. Manage your schedule, services, and customer communications responsibly.
4. Respond to booking requests and customer inquiries in a timely manner.

5.1 Platform Warranty Disclaimer

Flexiibook is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the reliability, accuracy, or availability of Flexiibook or that it will be uninterrupted, timely, secure, or error-free.

5.2 No Liability for Business-Customer Relationships

Flexiibook is not responsible for and expressly disclaims all liability related to:

• The quality, safety, or legality of services offered by Businesses
• The accuracy of Business listings or service descriptions
• Disputes between Businesses and Customers
• Any injury, damage, or loss resulting from the use of services booked through Flexiibook
• Any payment issues, refunds, or financial disputes between Businesses and Customers

Your use of Flexiibook is subject to our Privacy Policy, which governs how we collect, use, and disclose your personal information. By using Flexiibook, you consent to the processing of data as described in our Privacy Policy.

6.1 For Businesses

Businesses must comply with all applicable data protection laws when handling Customer data obtained through Flexiibook. Businesses are independent data controllers regarding such information and must have appropriate policies and safeguards in place.

All content, features, and functionality of Flexiibook, including but not limited to text, graphics, logos, icons, and software, are the exclusive property of Flexiibook and are protected by copyright, trademark, and other intellectual property laws. Unauthorized use may violate these laws.

Flexiibook reserves the right to suspend or terminate any account that violates these Terms or engages in fraudulent, abusive, or otherwise unacceptable behavior, as determined in our sole discretion.

Flexiibook may modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date at the top of these Terms. Your continued use of Flexiibook after such changes constitutes your acceptance of the new Terms.
